We know the legal stuff can be a little boring, but these terms are important.
They help protect both
you, our customers, and us by making sure everyone understands what to expect when dealing with Dying Breed Garage.

Dying Breed Garage T's & C's

1. PAYMENTS

Payment is due by the date stated on the invoice unless otherwise agreed in writing.
Vehicles must be paid for in full before or on collection unless approved account arrangement is put in place.

2. DEPOSITS


Dying Breed Garage reserves the right to request a deposit before ordering parts or commencing any work.
A deposit may be required where the total cost of parts is expected to exceed $500. Deposits may also be requested on our discretion where special-order or non-refundable parts are required.

3. ADDITIONAL WORK

If additional faults or required repairs are identified during the work, we will seek customer approval before carrying out additional chargeable work where reasonably practicable.

4. PARTS & SECOND-HAND PARTS WARRANTY

All second-hand parts supplied and fitted by Dying Breed Garage carry a 30-day warranty, subject to the terms of this agreement and applicable New Zealand law.
Second-hand parts are supplied based on their available condition and are not represented as equivalent to new parts unless specifically stated.

5. ENGINE WARRANTY

Replacement motors/engines supplied and fitted by Dying Breed Garage carry a warranty of 30 days or 5000km, whichever occurs first. subject to the terms of this agreement and applicable New Zealand law.
When an engine is replaced, any specified associated warranty items or components required as part of the engine replacement must also be replaced as advised by Dying Breed Garage. Failure to replace required components may affect the applicable workshop warranty.

6. LABOUR WARRANTY

Labour carried out by Dying Breed Garage carries a 30-day workmanship warranty, subject to the terms of this agreement and applicable New Zealand law.

This warranty relates to the workmanship performed by Dying Breed Garage and does not automatically cover unrelated faults, pre-existing faults, customer-supplied parts, or subsequent failures caused by other components.

7. MAJOR REPAIR RECHECKS

Major repairs require a follow-up inspection/recheck at 1000km or sooner if recommended by Dying Breed Garage 
Major repairs may include, but are not limited to:
- Engine replacements
- Gearbox replacements
- Timing chain replacements
- Sump and sealing repairs
- Other major mechanical repairs as advised by Dying Breed Garage
The customer is responsible for returning the vehicle for the required recheck.

Failure to have the required recheck completed may affect the applicable Dying Breed Garage workshop warranty. This condition does not exclude or limit any rights the customer may have under the Consumer Guarantees Act 1993 or other applicable law.

8. WARRANTY CLAIMS

Any suspected warranty issue must be reported to Dying Breed Garage as soon as reasonably practicable.
The vehicle must be returned to the Dying Breed Garage for inspection and assessment before warranty repairs are authorized or carried out elsewhere.
Unauthorized repairs or modifications carried out by another person or workshop may affect the Dying Breed Garage warranty.
Nothing in these terms is intended to exclude, restrict or modify rights or remedies available to the customer under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand law.

9. CUSTOMER-SUPPLIED PARTS

Dying Breed Garage reserves the right to refuse to fit customer-supplied parts where we consider them incorrect, unsuitable, unsafe or of unacceptable quality.
Dying Breed Garage is not responsible for failures caused by defective, incorrect or unsuitable customer-supplied parts.

10. WARRANT OF FITNESS (WOF)

A WoF inspection is an inspection of the vehicle against the applicable WoF requirements and is not a guarantee of the vehicle's overall mechanical condition.
Any repairs required following an inspection will be discussed with the customer before additional chargeable work is carried out where reasonably practicable.

11. VEHICLE TESTING & ROAD TESTING

Vehicles may be driven on public roads for diagnostic, testing, repair verification, WoF or other legitimate workshop purposes.

12. FUEL

Vehicles must contain sufficient fuel for the work being carried out and any necessary testing.
If a vehicle has insufficient fuel to safely complete the required work, testing or road testing, Dying Breed Garage reserves the right to add a reasonable amount of fuel and charge the cost to the customer.

13. VEHICLE COLLECTION & UNPAID ACCOUNTS

Customers will be notified when their vehicle is ready for collection.
Dying Breed Garage reserves the right to withhold possession of the vehicle where payment for authorized work remains outstanding, to the extent permitted by New Zealand law.
Vehicles should be collected promptly once the customer has been notified that work is complete.

14. OVERDUE ACCOUNTS & INTEREST

Invoices remaining unpaid for more than 30 days may incur interest at a rate of 1.7% per month on the outstanding balance, where legally permitted.

Customers may also be responsible for reasonable costs incurred in recovering overdue amounts, where legally recoverable.

15. DEBT RECOVERY

If an account remains unpaid, Dying Breed Garage reserves the right to refer the outstanding debt to a third-party debt collection agency or recovery agency.

Information reasonably required for the purpose of recovering the outstanding debt may be provided to that third party in accordance with applicable privacy and other New Zealand laws.

16. VEHICLE CONDITION & PERSONAL BELONGINGS

Customers should remove any valuable and personal belongings from their vehicle before leaving it at the workshop.
Dying Breed Garage is not responsible for loss of personal belongings left in a vehicle except where liability cannot lawfully be excluded.

17. EXISTING & UNRELATED FAULTS

Vehicles may have existing faults, wear or damage unrelated to the work being carried out.
Repairing one component may reveal or contribute to the identification of another fault. Dying Breed Garage is not responsible for unrelated pre-existing faults or failures not caused by our workmanship, subject to the customer's rights under applicable New Zealand law.

18. CUSTOMER RESPONSIBILITY

Customers are responsible for providing accurate information about the vehicle, its history, known faults, modifications and any relevant concerns that may affect the work being carried out.

Customers must follow any operating, servicing or maintenance recommendations provided by Dying Breed Garage following major repairs.

19. CONSUMER RIGHTS

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies the customer has under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other applicable New Zealand legislation.

Should a customer have a concern about work carried out by Dying Breed Garage, the customer should contact us promptly and give us a reasonable opportunity to inspect and, where appropriate, remedy the issue.

20. QUOTES / ESTIMATES

Quotes are based on the estimate of the information available at the time and may change if additional faults or parts are identified. Additional work will be discussed and authorised before proceeding where reasonably practicable.

21. DIAGNOSTIC SCANNING & ASSESSMENT FEES

Diagnostic scanning, inspection and assessment fees apply where quoted or agreed, whether or not further repairs are authorised.


22. COURTESY VEHICLES

Courtesy vehicles are provided subject to availability and must be returned in the same condition, with the same or equivalent fuel level. The customer is responsible for any fines, tolls, damage or loss arising from their use, except where otherwise required by law. The vehicle must only be driven by an authorised/licensed driver and must not be used for racing, towing or other prohibited purposes.


23. ACCEPTANCE OF TERMS

By authorising repairs, servicing, inspections, diagnostics or other work with Dying Breed Garage, the customer acknowledges that these Terms & Conditions apply to the goods and services supplied, subject to any separate written agreement and applicable New Zealand law.
